This Privacy Policy applies to the website (the “Site”) owned and operated by BionX International Corporation (“BionX”, “we”, “us”, or “our”). By using our Site and services, you consent to the collection, use and disclosure of any personal or non-personal information you submit to us (via this Site, by email, via telephone or by other means) in accordance with the terms of this Privacy Policy.

Our Privacy Commitment. At BionX we know how important it is to protect your personal information. Whether you are visiting us online or in person, we want to make every customer experience safe and secure. In keeping with that goal, we have developed this Privacy Policy to outline our guidelines for the collection, use, and disclosure of personal information by BionX. What Information does BionX Collect and How is it Used? At BionX, we collect two types of information: personal information and non-personal information. Personal information is information about an identifiable information. With your consent we collect personal information about you for a number of different purposes, such as to: fulfill requests for products, services or information; provide customer services; administer contests or promotions; offer new products and services; measure and improve the effectiveness of our Site or our marketing endeavors; and tailor our online or on-site offerings to your preferences. For example, we can only provide you a tailored response to your query through the Contact Us section of the Site if you provide us with your email address or phone number.

Sign-Up for Newsletters or Updates. BionX also offers an e-newsletter. You can choose to subscribe by visiting our Site or when visiting on-site. To enroll, we will collect your contact information (such as name and e-mail address). This information will only be used to send you the newsletter.

Opt-ing Out of Our Mailing List. If you have “opted in” or subscribed to one of our newsletters or mailing lists, we will always provide you the opportunity to “opt out” or unsubscribe. For example, each e-mail we send you will tell you how to decline further e-mails.

Listed here are some other examples of the ways that we collect information about you and how we use it:

Participate in a Contest, Promotion, or Survey. From time to time, we may run contests, promotions, or surveys. If you participate, you may be asked for contact information as well as additional optional survey information (for example, product preferences). Information from contest entries will be used to contact you if you win. Information BionX Collects Automatically. Like many other websites, we automatically collect certain information regarding website users. For example, we may collect the Internet Protocol (IP) address of your computer, the IP address of your Internet Service Provider, the date and time you access the Site, the Internet address of the website from which you linked directly to the Site, the operating system you are using, the sections of the Site you visit, the Site pages read and images viewed, and the content you download from the Site. Does BionX Disclose the Information it Collects? BionX does not sell your personal information. However we may share your information when you have consented to the disclosure, if the information is already publicly available, with third parties acting on our behalf, or as permitted or required by law, as described below.

Disclosure to Service Providers. BionX may share your personal information with certain service providers in order to provide products and services to you, to verify and validate information, and to address customer service matters. Examples of service providers include credit card issuers and delivery services. To reduce the risk of fraud or misuse of personal information, BionX may also verify your personal information, including but not limited to your address and credit card information, with third party service providers. These service providers are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements. Disclosure in the case of a Business Change. In the event our business undergoes a fundamental change such as, for example, a sale or financing, merger, transfer of all or a portion of our business or assets (“Business Change”), we may disclose your personal information to the counterparties to the transaction and their professional advisors as necessary for them to conduct due diligence and to complete the transaction, provided that the counterparties and their professional advisors are required to maintain the personal information as confidential and provided that any successor to our business may only use and disclose your personal information for those purposes for which you have provided consent to us. How does BionX Protect My Information? The security of your personal information is a high priority for BionX. When is My Information Removed? We keep your information as long as reasonably required to complete our dealings with you, or as required by law, whichever is longer. Subject to our requirements for continued retention of your information (i.e., billing, audit, or warranty purposes) or to fulfill our legal obligations, we will make every reasonable effort to honor your request.
